Open Question: Shop charges me for Trans Service $600, then tells me I need a new one $2900. Is that legal?

I brought my car in for a transmission check up, the car started jerking alittle bit in first gear, then I noticed my fluid was black. So i went to this Volvo/BMW shop whosaid i needed a transmission service for 600$, Said New fluid , transmission filter, and they would hammer out the kinks, and it would be perfect. So the next day the shop calls and says, " Yea we just finished, test drove it, driving like it's brand new". So i come pay them about 650$ after taxes. Then the next day, my car is stuck in 3rd gear , and I take it back to them. They take it for 3 days, then call me 3 days later, and tell me I need a " Used Transmission" 2900$. So i had my girlfriend take me there, and Asked them why i needed a new one, and why they didnt' tell me that before charging me 650$ for a service on a blown transmission, they said " I told them to service it, I said No i didnt, you guys called me and said this is what it needs" and the guy says to me " Sir, listen, we reset all the transmission codes, it's driving ok for now,,,, You can take the car", then he hands me my keys and I just walked out, about to have a heartattack. Is this legal? My car is driving 10x worse than it was before i took it to them, it was just an occasional jerk when shifting gears, Now it's completely stuck in 3rd gear.
